Telmex, the jewel of América Móvil’s communications empire, has lost an appeal it had sought against Mexico’s Federal Communications Institute in 2014. The telecomm regulator’s resolution at the time branded the company as overly dominant, prompting special economic conditions to be imposed.
The Second Collegiate Court for Telecommunications and Broadcasting rejected Telmex’s appeal, calling it groundless. Telmex initially lost an appeal on the matter back in October 2015.
The América Móvil subsidiary will now wait to be notified of the resolution, determining its range, justification and legal base. IFT has seen a particularly busy season, with 501 pending cases, 33 of which involved appeals over being declared ‘dominant’.
