Spain: CNMC and Canaries High Court strike down restrictions on vacation rentals

The High Court of Justice of the Canary Islands (TSJC) has announced its support for the appeal filed by the CNMC in November 2015 against the Regulation of holiday homes in the Autonomous Community of the Canary Islands, which introduced new regulations and restrictions on private leasing of accommodation.

The CNMC considered the decree would have introduced numerous obstacles to effective competition in the market, harming citizens and violating principles of competition promotion. This includes restrictions on establishing holiday homes in tourist and hotel areas, or renting rooms individually, among others.

The TSJC ruled in favor of the position of the CNMC, upholding the main objections presented by the markets regulator and annulling the prohibition on the existence of holiday homes in tourist areas, allowing the separate rental of individual rooms and eliminating obligations for pre-registration before beginning leasing.
