Spanish competition regulator CNMC has launched a public consultation on the methodology used to set the wholesale prices that Telefónica will charge other operators to access its optical fiber network in non-competitive areas of the country, the authority announced
Current regulation of broadband markets imposes on Telefónica the obligation to grant virtual access to its fibre optic network throughout Spain, except in the 66 most competitive municipalities. The prices of these services can be fixed freely by Telefónica, but it is established as a condition that the company’s most representative products, labelled ‘emblematic BAU products,’ can be replicated or counter-offered by the competing operators.
The Commission has stressed that it is one of the pioneers in setting up a system for regulating wholesale prices for fibre optic access based on passing a replicability test, in line with the principles introduced by the European Commission in 2013.
