When the processors of agricultural products behave monopsonistically they do so by underpaying their suppliers. In that event, everyone along the supply chain suffers antitrust injury. Due to the Supreme Court’s ruling in Illinois Brick, however, only the direct suppliers have standing to pursue damages under Section 4 of the Clayton Act. Sadly, this means that farmers and ranchers who are indirect suppliers will not be compensated for their losses. This paper addresses this inequity.
